Drayson Racing sets electric land speed record at 204MPH

Nissan's ZEOD RC may sound fast at 186MPH, but it's a slow poke next to Drayson Racing's B12/69EV. The modified Le Mans car just broke the FIA's land speed record, hitting 204.2MPH on a course at the former RAF Elvington base in Yorkshire. While Drayson is quick to admit that the 850HP racer is unusual, it sees the project as groundwork for both a 2015 Formula E car and technologies that could filter down to regular vehicles. The speed record also gives electric racing more credibility at a crucial moment -- when EVs are just starting to rival gas-powered counterparts on the track, any leap in performance can help.

Now the shoe is on the other foot, and it is time for the court to strike down a federal statute in order to advance a liberal policy goal rather than a conservative policy goal. Justice Scalia?s paean to the democratic process in his dissent sounds a little hollow, coming in the wake of his votes to strike down affirmative action programs and Section 4 of the Voting Rights Act?both of them the result of the democratic process, as much as DOMA was. Meanwhile, none of the liberals pipe in to explain how to reconcile the outcome of this case with the concerns about democracy that they expressed in dissenting opinions in the other cases. (Ginsburg, in Shelby County: ?That determination of the body empowered to enforce the Civil War Amendments ?by appropriate legislation? merits this Court?s utmost respect.?)

But this is a trite point, and never mind. The problem faced by opponents of DOMA is that there was no clear constitutional hook for striking it down. The Equal Protection Clause does not seem to apply because gay people (unlike, say, African-Americans) have not been regarded as politically weak enough to be a ?suspect class,? justifying heightened review. That means that only a rational basis is necessary to uphold DOMA and a rational basis is easy to find (uniformity, efficiency, blah, blah, blah). The Due Process Clause does not seem to apply because that clause protects only rights that are rooted in history and tradition, and the right of same-sex marriage, however compelling a moral issue it may seem today, is not such a right. Federalism says that (under ill-defined conditions) the U.S. government cannot trump state law, especially in an area like family law, but in fact there are plenty of federal laws that regulate marriage, at least along the margins.

In a remarkable opinion for the majority, Justice Kennedy manages to hit on all these theories without really endorsing any of them. After a long peroration on the importance of federalism, he disclaims it as a basis for the opinion?for the reason, I suspect, that if the unconstitutionality of DOMA is based on federalist principles, this case will not be a precedent that can be used to strike down state laws that refuse to recognize same-sex marriage in the future. He then vaguely invokes both due process and equal protection, without explaining how he overcomes the limits on those doctrines that I describe above. He does not, for example, declare homosexuals a suspect class, nor does he (or could he) claim that same-sex marriage has roots in history and tradition. In the end, he seems to hold DOMA unconstitutional because he is convinced that the purpose of the statute was to stigmatize gay people, and indeed there is some precedent for the idea that statutes based on animus are unconstitutional. But he does not provide a very convincing account of the motives of the legislators. Isn?t it possible to oppose same-sex marriage without hating gay people?

Kennedy?s opinion reminds me of two cases, both heavily criticized by constitutional scholars (for their reasoning, not necessarily their result). The first is 1965?s Griswold v. Connecticut, where the Supreme Court struck down a statute that prohibited the use of contraceptives, based on what Justice William O. Douglas called ?emanations? from and ?penumbras? of other constitutional provisions that said nothing about sex or contraception but did endorse other liberty interests. The second is 1990?s Employment Division v. Smith, where Justice Scalia, in the course of putting limits on the free exercise of religion doctrine of the first amendment, explained away some old cases on the grounds that they involved ?hybrid rights?: The statutes in question were struck down not because they violated the religion clause per se, but because they burdened both the practice of religion and other constitutionally protected activities. So there is this vague idea that certain constitutional interests standing alone may not invalidate statutes, but may suffice when combined together. Something like this idea might ultimately be the basis of Kennedy?s opinion. Gay people do not form a suspect class, but they almost do. Same-sex marriage is not a longstanding tradition, but same-sex relationships are. Federalism principles are not broken but they are eroded. Put together three almost violations, and you have a real violation.

But I think trying to find a jurisprudential explanation for this opinion, like the opinions in Fisher and Shelby Country, is a fool?s errand. Same-sex marriage is advancing while affirmative action is receding because that?s what the relevant majorities of the justices care about.

Stocks rise even as US economic growth slows

NEW YORK (AP) ? U.S. stock indexes moved higher in early trading Wednesday, despite news that the U.S. economy has been growing more slowly than first estimated.

In early trading, the Dow Jones industrial average was up 116 points, or 0.8 percent, to 14,879. The Standard & Poor's 500 was up 14, or 0.9 percent, to 1,602.

The gains were broad. All 10 industry sectors in the S&P 500 were up, led by health care and bank stocks.

The government reported Wednesday that the U.S. economy grew at an annual rate of 1.8 percent in the first three months of the year, significantly lower than the previous estimate of 2.4 percent. The Commerce Department said that consumers spent less than previously estimated, a troubling development in a country where consumer spending makes up more than 70 percent of the economy.

Investors, however, might have been pushing the market higher because they decided that they pushed it too low last week, a sentiment that investors credited for Tuesday's stock gains. Or they may have decided that the slower-growing economy will influence the Federal Reserve to delay any plans to pull back on stimulus measures. Those measures, which include buying bonds to push investors into stocks, and keeping interest rates low to spur borrowing, are meant to prop up the economy.

Fed Chairman Ben Bernanke set off a stock market plunge a week ago when he said the Fed could rein in the bond-buying program starting as early as this year. It wasn't that investors were surprised that the Fed will pull back on its stimulus programs: Most everyone expects that to happen eventually. It was more that they were worried that the Fed might pull out too soon, before the stock market could stand on its own without the Fed propping it up.

Other Fed officials have also scrambled to reassure investors that the central bank won't pull out of stimulus measures until it's sure the economy can handle it. Dallas Fed president Richard Fisher and Richmond Fed president Jeff Lacker are both scheduled to testify at a hearing with the U.S. House's banking committee Wednesday morning. While the Fed isn't the topic ? how to prevent bank bailouts is ? either could take the opportunity to speak on where they think Fed policy should go.

U.S government bonds rallied early Wednesday, sending yields lower. The yield on the 10-year Treasury note, a benchmark for many kinds of loans, fell to 2.53 percent from 2.61 percent late Tuesday. The yield has risen sharply over the last week as traders sold bonds in anticipation of the Fed winding down its bond-buying program. It was 2.19 percent June 18, the day before the Fed outlined its plans.

The price of gold fell sharply. Gold for August delivery fell $36, or 2.8 percent, to $1,239 an ounce. Crude oil slipped 27 cents, or 0.2 percent, to $95.08 a barrel.

At 1.8 percent, the country's economic growth for 2013 would be less than 2010 or 2012, and in line with 2011. And while investors are glad for growth ? after all, the U.S. economy shrank in 2008 and 2009 ? most say they'd like to see an annual rate of 3 or 4 percent before they can feel comfortable about the pace of the economic recovery.

In other stock trading, the Nasdaq composite index was up 29 points, or 0.9 percent, to 3,377.

Among companies making big moves:

?Fertilizer maker Mosaic fell after Citigroup analysts downgraded the stock to "Neutral" from "Buy," citing a hold-up in the company's stock buybacks and questions over demand for fertilizer. The stock fell $1.91, or 3.4 percent, to $54.

?Gun manufacturer Smith & Wesson fell, even after reporting that its profits doubled, as quarterly revenue missed analysts' forecasts. The stock fell 23 cents, or 2.3 percent, to $9.76.

?General Mills, whose products include Cheerios and Nature Valley granola bars, fell after reporting earnings predictions that came in slightly below analysts' estimates. The stock fell 49 cents, or 1 percent, to $47.84.

    Discovery Communications' John Hendricks: From Huntsville to ...

    "Why can't this be on TV? That was in Huntsville at UAH. That was a lingering question that was on the road to the Discovery Channel."

    HUNTSVILLE, Alabama - John Hendricks was a history student at the University of Alabama in Huntsville in the 1970s when he had an idea that would change television. Today, Hendricks is the founder and chairman of Discovery Communications, a worldwide empire with more than 100 channels and 1.5 billion viewers. Then, he was a work-study student helping his professors find documentaries to screen in their classes.

    "As I was looking through all this volume of catalogs for documentary films that were available, I just had this question," Hendricks said in an interview this month. "Why can't this be on TV? That was in Huntsville at UAH. That was a lingering question that was on the road to the Discovery Channel."

    Hendricks looks back at building Discovery and growing up in Alabama during the space race and the Civil Rights Era in the new memoir "A Curious Discovery: An Entrepreneur's Story" being published June 25 by HarperCollins. The book tells the stories behind some of the Discovery networks' most popular shows, including "Trading Spaces," "The Crocodile Hunter" and "Here Comes Honey Boo Boo," and it's a how-to manual for would-be entrepreneurs.

    In the book, Hendricks writes about his bad business moves as well as his good ones, including the day Discovery faced bankruptcy because his sole source for a new round of funding said "no" at the last moment. "All that counted was the Chronicle investment was dead," he writes, "and stupidly, I now realized, I had failed to use the intervening months to solicit any other investor prospects."

    "For something to be useful, people need to know the whole story," Hendricks said this month. "If you're going to have three or four successes in your life, you've probably had five to 10 significant failures."

    The book contains enough detail about Hendricks' path to be studied at business schools, but a man who has worked with everyone from Walter Cronkite and "Crocodile Hunter" Steve Irwin to Oprah Winfrey also has stories to tell. Among others, he recounts the terrible day he learned Irwin had died from stingray barb, and he takes readers inside his long, close relationship with Walter Cronkite.

    Some of Hendricks' best stories involve expanding Discovery's portfolio from documentaries aimed at 25 percent of the viewing public - his original audience - to reality programs like "Trading Spaces," and, eventually, shows like "Here Comes Honey Boo Boo." Now, Discovery is now a major source, under its different network banners, of programs not too far from ones Hendricks once dismissed as "Tattoo TV."

    Part of the reason for the stretch was economic, and again Hendricks is direct. "For us to be a global force in programming and to have the resources that we can continue to undertake very expensive productions like 'North America, which is now running on Discovery," he said in the interview, "we have to break beyond that 25 percent and reach over and develop a portfolio of networks that also work within (the) amusement and entertainment platforms."

    But Hendricks has come to appreciate reality TV in all of its dimensions, and he said that happened in stages. First, Hendricks said he realized that shows about people like Cake Boss Buddy Valastro and Georgetown Cupcake founders Katherine Berman and Sophie LaMontagne were not only incredibly popular, but inspirational. They tell the stories of legitimate American entrepreneurs whose paths aren't that different from Hendricks' own. Later, Hendricks said he came to see shows about different, even exotic lifestyles - whether Amish teenagers or Honey Boo Boo - as legitimate ways to satisfy legitimate viewer curiosity about their world.

    Hendricks was careful to put a fence around the original Discovery brand and spin off new networks to showcase new programming. He cites a big-time model for that, too.

    "You can think of it this way," Hendricks said in the interview. "Disney Corp. has a wonderful legacy of that all-family brand of Disney, but at one point to be able to survive and grow and prosper, Disney had to be able in their motion picture business to offer R-rated films. So, they did that through a number of separate divisions and studios that they owned that didn't carry the Disney brand. For years, they owned Miramax and Touchstone and Hollywood Pictures."

    Today, Hendricks stays busy with Discovery Communications and its ongoing challenges in a changing media world. When he's not in the corporate offices outside Washington, he's involved in developing Gateway Canyons, a Colorado resort designed to offer guests "curiosity adventures" on land protected from development. He travels for work and to satisfy his own curiosity - a recent trip to Tanzania included time spent with the last hunter-gather tribe in Africa - and visits Huntsville to see his brother-in-law Jim Sisson, lead engineer for the Apollo program's lunar rover, and his nephews Martin and Alan. Hendricks' sister, Linda, died some years ago.

    Hendricks life in Huntsville echoes through the book, and longtime residents will enjoy his memories of Budd's and Bill's Men's Wear, clothing stores where he worked; the day Huntsville schools integrated in 1963; and his parents' pleasure at seeing his picture in The Huntsville Times for winning a local insurance agents' essay contest on "The Free Enterprise System."

    "It's funny how the tiniest event can change the trajectory of one's life," Hendricks writes in his book. "Writing that essay was one of those moments, and I've often thought about how deeply it influenced everything that came after. Putting those few hundred words on paper forced me to really think about what motivates people to accomplish something in life, to invent or adapt new products, and to create experiences that did not exist before."

    Hendricks says growing up in Huntsville was key to what he has accomplished.

    "If you look through the book," he said in the interview, "there's a kind of continuing thread. I'm going to name-drop here, and I'm so sorry to do it, but Oprah had read the book and called me. And she said, 'John what you've done is a kind of business memoir, but what you've done is capture a thread: What was the thread that led to Discovery?'

    "I have to say that Huntsville was just a big part of that thread," Hendricks said. "It was such an inspiring place to grow up."

    Plane believed to be carrying Snowden in Moscow

    MOSCOW (AP) ? An Aeroflot flight from Hong Kong believed to be carrying a former National Security Agency contractor wanted by the United States has landed in Moscow.

    Hong Kong's government said Edward Snowden was allowed to leave but did not say where he was headed.

    Russia's state ITAR-Tass news agency cited an unnamed Aerflot official saying the Snowden was on Flight SU213, which landed on Sunday afternoon in Moscow.

    The report said he intended to fly to Cuba on Monday and then on to Caracas, Venezuela.

    Police continue to investigate the murder of 27-year-old Odin Lloyd, and Patriots tight end Aaron Hernandez continues to get legal advice from a large, international, corporate firm with more than 1,000 lawyers.? If Hernandez ever ends up facing murder charges there?s one thing he needs more than anything else:? A lawyer who has tried many murder cases.

    For now, Hernandez is represented by Michael Fee of Ropes & Gray.? Fee is the obvious choice from the firm?s broad corporate practice.? Basically, he?s the guy who represents the corporate muckety-mucks who get charged with ?white collar? crimes.

    Fee?s online bio, the carefully-crafted practice summary prepared for every lawyer at every large firm, makes it clear that Fee has plenty of experience in criminal cases, but says nothing about murder cases.

    Plenty of white-collar criminal defense lawyers at major firms started as prosecutors.? So did Fee.? But his online bio indicates he enforced laws regarding corruption from public officials, not laws against murder or related crimes.

    At some point, Hernandez will need to realize that he may need something other than a white-collar criminal defense lawyer.? If he?s charged with murder, Hernandez will need someone who has tried murder cases.? Preferably as both the prosecutor and as the defense attorney.? It?s critically important to have a lawyer who knows from experience how these cases get put together, and how they can be taken apart.

    Also, Hernandez arguably would be far better off with a lone Vincent LaGuardia Gambini-style wolf than a prominent partner in a prominent firm.? Lawyers in large firms can be almost as worried about the questions they?ll face from their colleagues as they are about getting a successful result for the client.? Did you do that?? inquiries they?ll face from jerk-store colleagues who like to point out in passive-aggressive fashion that they would have done a better job.

    If Hernandez ever is charged with murder and if Fee ends up sitting at counsel table as the lead lawyer, he?ll possibly be out of his element ? but he?ll never be able to admit it.? The best (or perhaps worst) example of this comes from the defense fashioned by the late Vincent Fuller on behalf of Mike Tyson in 1992.? Fuller, a powerful lawyer at a big D.C. firm who represented Don King on tax evasion charges and proved John Hinckley was insane when he shot Ronald Reagan, had no experience handling rape cases in Indiana.? And it showed.? Fuller, as explained by Sports Illustrated at the time, painted Tyson as sex-crazed animal in order to show that Tyson?s victim had to know what was going to happen when she went to his hotel room.

    The picture painted by Tyson?s own lawyer likely made it easier for the jury to send him to jail.

    If Hernandez faces murder charges in Bristol County, Massachusetts, he needs someone who has prosecuted murder cases in Bristol County, Massachusetts (preferably with the person who?ll be prosecuting Hernandez), who has defended murder cases in Bristol County, Massachusetts (preferably against the person who?ll be prosecuting Hernandez), and who has practiced before the Bristol County judge who?ll preside over the case.? Even if Fee has none of those qualities, it will be tempting for Fee to explain to Hernandez that Fee can do the job, since Hernandez has one thing most murder defendants don?t ? a lot of money to pay the bill.

    In the end, that money will be best spent on someone who knows the prosecutor well, knows the judge well, knows the courtroom well, and knows the ins and outs of crafting reasonable doubt in a Bristol County, Massachusetts murder case.

    Actually, the smartest move could be to assume charges are coming and to hire that lawyer now.? It?s obvious that Hernandez being targeted for potential prosecution, at a minimum for obstruction of justice.? The sooner he?s getting advice from a uniquely-qualified person who?d handle a murder trial, the better.

    For all anyone knows, Hernandez already is.

    LGBT Community Untapped Market Consumer Brands - Business ...

    Rick and Liam wanted recognition of their commitment to each other, so they did what many gay couples are doing these days.

    They boarded a plane to New York where marriage between same-sex partners is legal. After hearing about the couple?s plans, the JetBlue crew on their flight showered them with special attention including free drinks and best wishes.

    When Rick and Liam realized they lacked a witness for the wedding, one of the flight attendants accompanied the men to city hall to serve in that role, showing up at the nuptials only after stopping to get a special dessert for the occasion. The newly married men penned a heartfelt ?thank you? letter to JetBlue. The airline proudly posted the story on their blog and distributed it to the press.

    JetBlue is not alone in its desire to shine a light on its support of its gay consumers. Many brands are waking up to the opportunity that the LGBT market today represents for their business.

    Brands from Apple to Budweiser to JCPenney are becoming more interested in gay consumers, with many brands making concerted efforts to target the LGBT market. ?

    Why? What is really at stake? Here are just a few numbers surrounding LGBT consumers and the differences in spending power of gay households vs. the American general market:

    • 23% higher median household income1

    • 24% more equity in their homes1

    • 26% of gay men say they will pay more for top quality brands2

    • 30% have taken a major vacation in the past year2

    • 40% bought a new smart phone in the past year2

    Estimates put the buying power of the LGBT community at over $800 billion annually. Some marketers are realizing that they may need to adjust their plans to accommodate this segment, or at least make sure that their marketing spending is inclusive of this valuable target. But many brands have been slow to pick up on the impact of the gay and lesbian consumer on their sales. Some are content to let their general market messages do the job of reaching everyone, and see no reason to pay special attention to LGBT consumers.

    Are gay consumers? spending habits and brand loyalties really all that different? In some categories, maybe not. But in others, the impact of gay consumer spending is more profound. Here are a few differences between the purchasing habits of gay consumers and everyone else.

    Gay Shopping Habits Pay Off For Brands ? Same-sex households spend at rates fairly similar to other households, when it comes to shopping for consumer packaged goods. However, gay and lesbian households make 16% more shopping trips than the average U.S. household ? 173 vs. 149 per year.3 The impact on total spending equates to about 25% more for same-sex households. Male same-sex households are especially likely to spend more frequently, shopping nearly 30% more often than the average household. On average, that?s $2,045 more per year spent on packaged goods in male same-sex households.3 This means that brands have more opportunities to reach LGBT consumers at retail to influence their purchase behaviors and brand preferences.

    Gay Consumer Brand Loyalties ? Are the factors that influence the brand selection of gay consumers really that different? They are more likely to pay for quality brands and to influence others as well. When asked if it is worth paying extra for top-of-line or cutting edge products, 26% of gay men agreed, considerably higher than the average American?s answer to that question. And LGBT consumers are a source of word-of-mouth marketing for brands. Gay men (64%) and women (65%) agreed that when they find a brand they like, they are likely to make a point of telling their friends about it. That?s well above the average of all U.S. consumers.2

    Gay Consumers and Finances ? Although there is some disagreement about income of gay consumers compared to the average American, most sources indicate LGBT consumers have more disposable income. According to a survey done by Prudential in 2012, gay consumers reported annual household incomes around $61,500, significantly higher than the national median of just over $50,000.1 Gays were more likely to have higher educations, to carry less debt, to have more savings and were less likely to be jobless with an unemployment rate of almost a point below the national percentage. Additionally, LGBT homeowners in the survey had significantly more equity in their homes and were better financially set for retirement.1

    But are gay consumers open to brand marketing messages tailored to them? With a constant media-driven debate reminding gay Americans of inequities including workplace discrimination, marriage inequality, and cultural clashes, on an almost daily basis, gays and lesbians are paying attention to brands that appear to be allies.

    And even for brands that do not have any plan to market directly to LGBT consumers, the shift in America?s attitudes about the issue is requiring a new sensitivity. Brands from beer to candy bars have found themselves the subjects of consumer or industry criticism when they used ??harmless? jokes in ads that inadvertently seemed to show same-sex relationships in a bad light. And the concerns are not always coming from gay groups. More and more progressive general market consumers are expressing their support of gay issues and holding brands accountable as well.

    With billions in spending at stake, it?s more important than ever that brands, even those who have no interest in marketing to gay Americans, become sensitive to these issues. This loyal group of consumers is ready to reward brands that really speak their language.

    Border security amendment offered in Senate

    WASHINGTON (AP) ? An agreement to vastly increase fencing, patrols and high-tech monitoring along the U.S.-Mexico border was formally unveiled in the Senate Friday, providing powerful momentum to a far-reaching immigration bill backed by the White House.

    With the border security amendment finalized, the immigration legislation immediately picked up an additional likely Republican supporter: Sen. Lisa Murkowski of Alaska, who signed on as a co-sponsor of the amendment.

    "This amendment will put to rest any remaining credible concerns about the border, about border security," Senate Majority Leader Harry Reid, D-Nev., said on the Senate floor as he filed the measure and announced procedural steps to bring it to a vote early next week. "The opposition of a small group is not going to stop this bill from moving forward," Reid said.

    The deal doubling Border Patrol agents and adding hundreds of miles of fencing along the Southwest border had already won support from four other undecided Republican senators who are now likely to back the immigration bill when it comes to a final vote next week. The legislation opening the door to citizenship for millions now appears within reach of securing the broad bipartisan majority that its authors say is needed to ensure serious consideration by the GOP-controlled House.

    However, the outcome there remains far from certain because many conservatives are opposed to offering citizenship to people who came to this country illegally.

    "We really have tried to secure the border in a way that we hope can get bipartisan support and that Americans want," Sen. John Hoeven, R-N.D., an author of the amendment, told The Associated Press in a phone interview Friday. "We're hopeful to have a good bipartisan majority."

    Sen. John McCain, R-Ariz., said on Fox News Channel Friday that "if there's anyone who still will argue that the border is not secure after this, then border security is not their reason for opposing a path to citizenship for the people who are in this country illegally."

    "Is it more than I would have recommended? Honestly, yes," McCain said. "But we've got to give people confidence."

    Hoeven developed the amendment along with Republican Sen. Bob Corker of Tennessee, in consultation with McCain, Sens. Lindsey Graham, R-S.C., Chuck Schumer, D-N.Y., and other members of the so-called Gang of Eight senators who wrote the immigration bill. It prevents immigrants now here illegally from attaining permanent resident status until a series of steps have been taken to secure the border.

    These include doubling the Border Patrol with 20,000 new agents, 18 new unmanned surveillance drones, 350 miles of new pedestrian fencing to add to 350 miles already in place and an array of fixed and mobile devices to maintain vigilance, including high-tech tools such as infrared ground sensors and airborne radar.

    The new provisions would be put in place over a decade, in line with the 10-year path to a permanent resident green card that the bill sets out for immigrants here illegally. During that time, the immigrants could live and work legally in a provisional status.

    Hoeven said the 10-year cost of the border security amendment included $25 billion for the additional Border Patrol agents, $3 billion for fencing and $3.2 billion for other measures.

    It's "border security on steroids," said Corker, who along with Hoeven had been uncommitted on the immigration bill. Both are now prepared to support it, assuming their amendment is adopted. Sens. Dean Heller, R-Nev., and Mark Kirk, R-Ill., also announced their support for the deal Thursday.

    White House press secretary Jay Carney said the border deal "would constitute a breakthrough" on immigration. "We're pleased that Republicans and Democrats continue to work together toward comprehensive immigration reform," he said.

    The deal on border security came together quickly over the past several days after talks had bogged down over Republicans' insistence that green cards be made conditional on catching or turning back 90 percent of would-be border crossers. Schumer, other Democrats and Obama himself rejected this trigger, which they feared could delay the path to citizenship for years. Obama made his objections known in a phone call to Schumer from Air Force One during his trip to Europe for the Group of Eight summit earlier in the week, according to a Senate aide who spoke on condition of anonymity to discuss private deliberations.

    The breakthrough came when the Congressional Budget Office released a report Tuesday finding that the bill would cut billions of dollars from the deficit. Schumer's top immigration aide, Leon Fresco, had the idea of devoting some of those billions to a dramatic border buildup.

    Graham, who helped run interference between Corker and Hoeven and Democrats in the group, said that with the budget office finding in hand, he sat down with Schumer and Corker and said, "OK, let's go big."

    The idea immediately appealed to the left and the right.

    For Republicans, it provided concrete assurances that the bill would aim to achieve a secure border. For Democrats, it offered goals that, if dramatic, were achievable and measurable.

    Still, not everyone was won over.

    Shortly before Corker and Hoeven went to the Senate floor to announce their agreement Thursday afternoon, five leading Republican opponents of the bill held a news conference to denounce the deal as little more than an empty promise.

    "In short, I think this amendment is designed to pass the bill but not to fix the bill," Sen. David Vitter, R-La., said.

    About 10 Republicans have indicated they will vote for the bill, far more than enough to ensure it will have the 60 votes required to overcome any attempted filibuster by last-ditch opponents. Democrats control 54 seats, and party aides have said they do not expect any defections.

    In addition to the border security components and eventual citizenship for the estimated 11 million people living here illegally, the immigration bill would create new work visa programs and expand existing ones to allow tens of thousands of workers into the country to work in high- and low-skilled jobs.

    You don't see many phones like the $59.99 Sanyo Innuendo. First of all it's a feature phone, which is already a dying breed. But it looks more like a smartphone from the outside, with a gray, mysterious OLED touch panel you can use to dial numbers. But what's this? It also opens, like a book, to reveal a fantastic little QWERTY keyboard on one side and a tiny-but-capable display on the other. It's held back by some issues like a nonstandard headphone jack and short battery life, but it's still a decent, affordable option for style-minded users looking to save some money with Boost.

    Boost Features
    The Sanyo Innuendo has been around for quite a while, but this is the first time we're taking a look at it on Boost. Not much has changed in the feature phone world over the last few years, so this phone still holds its own when compared with newer options like the LG Rumor Reflex?and the Samsung Array.

He doesn't need to put his feet on the ground because the two rear wheels provide plenty of stability. Daniel Borrmann is satisfied with the first test drive of the Electromobile City Scooter. The new three-wheeled electric vehicle from the Fraunhofer Institute for Industrial Engineering IAO in Stuttgart is designed to open up new possibilities for the urban transportation of tomorrow. "Although electric scooters offer many advantages, a lot of motorists either cannot or do not want to make the switch for trips into town. They simply lack the experience of traveling on two wheels," says Borrmann. This is exactly where the Electromobile City Scooter comes in.

    Thanks to the additional wheel on the rear axle combined with a special chassis, the electric vehicle manages to be both stable and nimble. To enable it to lean into curves despite having two rear wheels, the IAO researchers suspended the rear wheels separately and supported them in the frame by means of air springs. In fact, the model is scarcely any wider than a regular two-wheeled scooter. Following initial drafts, the scientists worked out detailed specifications, which the engineering firm GreenIng subsequently implemented on a conventional two-wheeled electric scooter. "We demonstrated that our idea works on a real scooter. In the next step, we want to make the vehicle even more comfortable. For example, by means of systems for riding helmet-free, for protecting riders from the elements, and for luggage storage," says Borrmann, summarizing his team's objectives, before getting back on the scooter and zipping off into a new round of tests to the sound of the engine's gentle hum.

    MINISTRY VALUES and STRATEGY

    I. The Director of Campus Recreation must be committed to the Lordship of Christ. This not only means having a Biblical Worldview, but it involves a transformation in every area of one's lifestyle. The Director of Campus Recreation should continually seek opportunities to grow. She/he needs to have a strong character through the regular practicing of the spiritual disciplines (e.g. prayer and study of Scripture). The Director of Campus Recreation should have a developed vision for what God can do in the campus community through campus recreation, wellness programming and intramurals. A strategy for ministry is then created for accomplishing this vision. The Director's ministry and service are further enhanced by the skills of efficiency, creativity and deep compassion for students and service.

    II. The Director of Campus Recreation's primary strategy for building committed leaders should focus on pouring one's life into several paraprofessional student staff while maintaining general friendships and creating a sense of community with the rest of the campus. The ultimate goal is to reproduce the life of Christ in others (discipleship) so that in turn others can reproduce Christ's life in their friendships. This multiplication effect will enhance the number of students that can be reached for Christ and eventually led to the development of a sense of Christian community throughout the entire campus. This type of community atmosphere creates the greatest opportunity for students to grow and to feel supported.

    OVERALL FUNCTION

    The Director of Campus Recreation position has been created to coordinate and administer an exciting and expanding campus recreation program for approximately 3,000 resident and commuter students and 700 faculty, staff and administrators. The Director also provides supervision for the Recreation and Wellness Center facility, including the training and supervision of the Assistant Director of Aquatics and Intramural Sports, 15 student workers, building maintenance, facility access and policies, and recreational equipment purchases and maintenance. The Director supervises over 15 paraprofessional students for the Recreation and Wellness Center and intramural sports. The Director reports to the Director of Athletics and the role is considered an essential role in the retention and satisfaction of students.

    SPECIFIC RESPONSIBILITIES

    • Direct, develop, plan and organize a yearly, monthly, weekly, and daily program for effective intramural, wellness, and recreational use of the Recreation and Wellness Center for the entire IWU community in conjunction with the facilities coordinator in the athletic department.
    • Develop and coordinate an aggressive academic year intramural program with a variety of sports and involvement opportunities with annual student participation goals of 70% or better.
    • Maintain and update Intramural Handbook with policies for participation and rules for competition.
    • Supervise a significant number of intramural activities and recreation programs to have a first-hand impression of how well the program is performing.
    • Create and direct appropriate promotion and information distribution regarding programs and facility via up-to-date webpage, marketing materials, etc.
    • Assess the aquatics and intramurals programs; keep statistics on activity/event results, number of participants, costs, staffing, etc.
    • Coordinate cutting edge and expanding recreational activities and open recreation opportunities.
    • Collaborate with other campus entities, develop and coordinate recreational activities to support University traditional events which include Homecoming, Youth Conference, Kid's Weekend, conferences, extramural competitions, club events, etc.
    • Direct the facility supervision for the Recreation and Wellness Center, checking each day to be sure all furniture, equipment, and the like are in their proper places. Completing work orders to insure the RWC is regularly maintained.?
    • Develop and implement an equipment maintenance and replacement plan.
    • Monitor and upgrade the fitness center, pool, weight room and racquetball courts, including enforcing policies for safe use, equipment, repairs, and improvements. Stay current regarding fitness equipment and procurement.?
    • Create and coordinate the distribution of Recreation and Wellness Center "guest" passes and all related access policies for the facility.
    • Select, train and supervise a student staff of more than 30 for intramurals, the RWC front desk, and the RWC weight room; including recruitment of qualified staff, work schedules, regular staff meetings, etc.
    • Maintain and update Student Employee Handbook with all pertinent policies and procedures.
    • Develop appropriate policies for the smooth operation of the Recreation and Wellness Center and related programs.
    • Coordinate with the Director of Conference Services to provide quality service to those involved with summer conferences.
    • Serve on Employee Wellness Program Committee.
    • Annually establish in writing, goals and objectives for program growth and development in all areas.
    • Prepare an annual report and evaluation of activities/events offered and services rendered, in all program areas as it pertains to the goals outlined at the beginning of the year.
    • Attend departmental meetings, committee meetings and other meetings associated with the position.

    GENERAL EXPECTATIONS

    • Request, monitor, and oversee the Campus Recreation budget.
    • Participate and present in professional organizations that pertain to this position.
    • Counsel with students and refer as necessary regarding spiritual, personal, emotional, or academic problems.
    • Maintain a professional image and manner consistent with Indiana Wesleyan University's mission and goals. Support the policies of the Student Handbook with integrity.
    • Fulfill other duties as assigned by supervisor.
